SUPPORT - CHILD & SPOUSAL

CHILD SUPPORT:

     In California, child support is calculated using a computer program called the "Dissomaster". This computer program is used in all California courts. Numbers are plugged into the computer program which then calculates a support payment amount called "The California Guideline Amount". The word "guideline" actually is the mandatory minimum amount of child support which must be paid barring certain hardship circumstances. Unless there is a written agreement between the parties to the contrary, the "guideline" amount is the amount of child support the Court will order. Often, argument arises over the "numbers" to be plugged in, for example - parties may contest that one spouse's claimed income is actually higher than stated etc.
     Support payments may be voluntarily paid, or automatic - that is, by way of wage assignment (garnishment from one's wages). While it is always hoped that child support obligations will be voluntarily honored, problems can and do arise with voluntary payment arrangements. SPOUSAL SUPPORT:

     Spousal support is based, among other factors, upon the length of the marriage and the financial and employment circumstances of the couple. The amount of temporary spousal support is also set by the use of the Dissomaster system. Permanent spousal support is at the discretion of the presiding Judge based on numerous factors in the Family Law Code.
     Certain mandatory factors in the California Family Law codes include the marital standard of living, financial circumstances of the parties, ability to pay, etc.
